Not In Indiana

The State of Indiana has on it's books a law regarding Same Sex Marriage. It states the following:

IC 31-11-1-1
Same sex marriages prohibited

Sec. 1. (a) Only a female may marry a male. Only a male may marry a female.

(b) A marriage between persons of the same gender is void in Indiana even if the marriage is lawful in the place where it is solemnized.

What section b there means to me is that even though my wife and I were married in Iowa, the State of Indiana will not recognize it.

 

Gay Chicago News Reports the Following

 

A lawsuit filed on behalf of a lesbian couple, one of whom was killed in the Aug. 13 stage collapse at the Indiana State Fair, is challenging Indiana law for not recognizing the rights of gay and lesbian couples who are married.

Valparaiso attorney Kenneth Allen filed the lawsuit Aug. 19 in LaPorte County, Ind., Circuit Court on behalf of Tammy VanDam, who was killed in the stage collapse, and her partner, Beth Urschel, who was injured in the accident. VanDam and Urschel made their home in Wanatah, Ind.

The lawsuit seeks $60 million in damages based on claims that the stage was improperly constructed and that fair officials and promoters were negligent by failing to heed warnings of the impending storm and high winds that brought down the massive structure.

Seven people were killed in the collapse, including lesbian activist and health educator Christina Santiago of Chicago, and dozens more were injured.

In addition to the claims of negligence, though, the lawsuit filed by Allen alleges that Urschel was unable to recover VanDam’s body from the coroner’s office in Indianapolis, who told her they could only release VanDam’s body to legally recognized next of kin. Urschel and VanDam were married a decade ago in Hawaii but Indiana doesn’t recognize the marriages of same-sex couples.

“Here the only difference is we had two women who were married, as opposed to a man and a woman,” Allen said Aug. 22. “We believe that they are entitled to the same treatment under the Constitution.”

Allen said he’s eager to take up the issue in court in Indiana, where legislators are trying to pass an amendment to the state constitution that would ban recognition of same-sex marriages, civil unions and domestic partnerships. There’s already a law on the books in the state that bans recognition of same-sex marriages.

“I’m convinced first of all that it’s obviously unjust, unfair and inequitable,” Allen said. “But I’m also convinced that the Indiana Legislature is never going to do anything about it and unless we address it through the courts, this inequity isn’t going to change. …I guarantee that however long it takes to win this case, it will happen much faster than waiting for the Indiana Legislature to address it.”

 

Sadly absent from any local Indianapolis news (although I sent them the information), I got more of the story from Huffington Post Chicago

"No doubt it's a challenge, but we're up to it," Allen told the Huffington Post. "The reality is we can't just stand idly by and accept this kind of inequity. People should be treated fairly and equitably. This is fundamentally wrong and unfair and I think it's important for us to try and rectify it."

While unfair, such difficult situations are not uncommon for same-sex couples who encounter tragedy both while traveling out of the state where they live, or by simply living in a state where any out-of-state marriages, civil unions or domestic partnerships they might have are unrecognized.

Betty Tsamis, a Chicago attorney who has a long history of working closely with the LGBT community, described this fact as "the difficult and unfortunate reality for same-sex couples."

"The legal status of our relationships is a free-for-all whenever we leave the boundaries of the states that honor our relationships," Tsamis told the Huffington Post. "Just like states were allowed to deny recognition, at whim, to interracial marriages the current legal status quo has legalized this same form of discrimination on same-sex couples."

 

As I petition Congress both US and local to get the laws changed, I can only hope that this will help. In the mean time, please help to make change by signing the following petition.

Happy July 4th..... Land of the Cruel and Unequal

Let me say, first of all, that I love the United States of America. There is no greater country in the entire world. I am so proud to be an American. I will never take for granted that freedoms that we have and the price that has been paid for our freedoms.

My friend lost a son in Afghanistan, my own father was a World War II veteran. I have always been the most patriotic person. I love America. It breaks my heart and I feel betrayed by my country and my family, that they cannot accept us for who we are; for whom we love.

Governor Scott Walker (Wisconsin) believes a new law that gives gay couples hospital visitation rights violates the state constitution and has asked a judge to allow the state to stop defending it.

What is the point of this cruelty. Who cares if people who love each other visit each other in the hospital. This is nothing but power hungry, power mongering political play and a case of cruelty. I don't know what the point would be to prevent people seeing each other. For those of you who have experienced this type of discrimination and homophobia, I am sorry. I work in a hospital and I have never seen this type of discrimination and cruelty. I wrote a blog entry on how to avoid this type of evil cruelty. How to Bypass Hospital Homophobia/Discrimination

Matthew Shephard Memorial Site states the following.

On October 6, 1998, Matthew was beaten and tied to a fence just outside of Laramie, Wyoming. Yet, this one tragic event shook the nation. It may have been due to the fact that this murder took place in small town America, as well as a college town. Matthew was a student at the University of Wyoming in Laramie. Even now, it is not fully clear what went on that night of October 6, 1998, but it appears to be a combination robbery and gay-bashing. Even though it has been over five years since Matthew's death, violence against gay, lesbian, bisexual, transgender as well as toward minorities continues unabated. This being the case, it is important that as many sites such as this be made available to keep the awareness of this serious problem before the public. In election years, it is all the more important that these issues are addressed by our future leaders. Even though Matthew's murder appears to have been motivated in part due to his being gay, this site exists as a resource for all human rights issues, not just those of the LGBT people.
It is my belief that people like Governor Walker probably did not find the torture and death of Matthew Shepherd disturbing, hateful and sad.

A Republican Representative Eric Turner (R-Marion)in the State of Indiana made the comment as he co-sponsored a bill to further discriminate against EQUAL RIGHTS for all Hoosiers, "...it's nothing personal...it's not like this is hurting anyone..."

I beg to differ. Anytime that discrimination is written into the Constitution of any state, there is hurt being done. Our elected leaders cannot be so oblivious to this fact. They truly cannot believe that they are doing no harm to anyone by separating loved ones...please tell me they don't believe that people who are being told that they are second class citizens...please tell me that they don't believe that no harm is being done. Well, maybe they do believe that because they believe that the people being discriminated against are not deserving of a second thought. Maybe they believe that this group of people is undeserving because of who they love.

Just a quick thought on "He who lives in glass house should not throw stones..." and also the wonderful quote from William Shakespeare, " the lady doeth protest too much..."

My own Independent Fundamental Baptist family has now chosen to not have my wife, our boys and I be part of family functions. Upon announcing to my family that my love of 12 years and I were going to travel to the wonderful state of Iowa and get married, I received a type written letter from my two older sisters, their husbands (one of whom is an evangelist who goes around the United States preaching as to why Christians should memorize the Bible), and their adult children. It said that they had many family meetings (Of which I, my wife, or our other adult nephew were not part)and that:

"We have painfully decided as a family that if you follow through on this immoral act, we would be forced to break a lot of family relationships with you. We would have no desire to have you present at our usual family gatherings...This hurts to say this, but you would no longer be welcome in our homes."

They go on to say that the decision is mine. Yeah right. The sad thing is this, they really think that they are showing me "tough love". They really think that before God they are doing the right thing. They have been sadly disillusioned by power hungry, obsessive compulsive, and tyrannic church leadership. I don't know what they want me to do. Do they want me to give up my wife, my sons, my life, my family...that is exactly what they are asking me to do. Amazingly unbelievable isn't it. It is not their job to tell me how to live my life. I have done major research on what he Bible says about Homosexuality and have posted many entries as to my beliefs on what the Bible says. For those of you who are doubting my ability to understand the Bible I wish to tell you that from the 5th grade to graduating from the Independent Fundamental Baptist School and College, I have been in Bible School.

What Other "Abominations" Should We Condemn?

Then there is the Immigration Discrimination Issue

The vast majority of Americans have no clue as to what it takes to immigrate to the United States. Sadly, President Barak Obama made the statement that there are those who have stood inline for legal immigration..." If it were that easy, to just get in a line and get legal immigration, there would be few illegal immigrants....there would be no undocumented. However, for bi-national same sex couples, there is no line in which to stand. Unless our loved ones are rich, or extremely talented (like Sammy Sosa, Celine Dion), can get a job that no American can do, or are oppressed in their country by their government there is no line for binational same sex couples. Please consider my blog entry on how uneducated the regular American person is about immigration.

This fourth of July, let us hope and pray that this is the last one that we will say that there is a group of people in the United States that does not have equal rights. This is after all, the land of the free where all are created equal.

The Last Night - Video

This is a video made by Inger and Philippa on their last night together before Philippa had to return to the United Kingdom. The sound is rough because they had a fan running in the background and sound perfection was not what was on their mind I assure you. I have shared their story twice in two different stories on this blog because these two ladies inspire me with their love, faith, courage, and their tenacity to get things changed.

Inger speaking:

Hi everyone, this is Inger and Philippa here, and we said we'd make a video and so we are. It is the last full night we will spend together for god knows how long and I for one am not coping. I don't want this. I need everybody out there to realize that this is wrong. You all need to vote, talk to your congress people, your senators. I'm not going to give you a sermon, but it is so hard to know, that...uh...the life we share together is on the whim of a government that doesn't even know we exist.

Philippa had difficulty coming in through immigration and the U. S. border control, she was interviewed twice and got her documents taken off her which means that after waiting six and one half months the likelihood of her coming in in the next year seems pretty slim, unless there are some changes made.

We've had a good three weeks, it's been really wistful, but we've had some great times, a lot of smiles but now we are down to the wire she's going to leave tomorrow evening and my heart's breaking. I don't want to keep doing this.... but I will. I'll wait as long as I have to to be with my family. But...for those of you who are with the ones you love...treasure every minute you have. And for those of you in our same situation, contact me. We have to figure out a way to change things...this can't keep happening.

If you are in a bi-national couple, it's worth it. It's hard, God I know it's hard, living on phone calls and living on web cam and living on letters and packages, planning the occasional trip, it's difficult, but it beats a half life of living alone or settling for something other than true love. That's my sermon.

We need to change the world and we can't do it alone, I can't do it alone, but I'm going to do everything I can. I spent two days at Pride talking to hundreds and hundreds and hundreds of people and ... I would say seventy- five percent of them had no idea, and there were a few bi-national couples who I met who were either they couldn't make it, they couldn't last because it's so hard...or...they've gone the other way and are just flying under the wire and I don't want to do either of those things. I want to do it right. I want to have this woman by my side, show the world that I love her...(dog whining in background) And our pug (turning away) (laughs) wants you to know that he loves his mommy and he wants her to stay with us (Oscar the pug barks in agreement) and it's just not right. (Oscar continues to whine and Philippa and Inger turn away and back again and laugh) (Inger sniffling)

We haven't been moping the whole time but this is to be expected and so we are doing this tonight because I will be moderately hysterical tomorrow (fake smile) and uh...(dog barking) not be able to explain what I'm feeling. It's this tight wad of anger and sadness that I'm feeling .... (breathes big sigh) I don't know what to do...so...anyone out there who can figure it out and help me out ...help us out...I'd truly appreciate it. (turning to Philippa) I get it all? (Philippa nods) (turns back to the cam) We love all of you ...and we're glad to have you in our lives (crying) I don't know what to tell you but thank you for everything (shakes head) we're gonna ask for more so you might as well help us so we'll shut up. Each and Every Verse the Text and the Context

The Culture and the History of the Time

(There are only six by the way)

 

Let's start with the big one:  Leviticus 18:22    Do not lie with men as you would with women.

Leviticus 20:13     If a man also lie with mankind as he lieth with a woman, both of them have committed an abomination; they shall surely be put to death; their blood be upon them

In order to understand these verses, one must understand the culture of the time.  In reading the entire chapters, we are told three different times that they were being forbidden to live as the Egyptians and the Canaanites.  Biblical historians will tell you that the Cannanite religion during this time also included sexual rites.  These were done to ask for the blessings of their god.  These sexual rites included whole families; Husbands, wives, cousins, mothers, daughters, nieces and nephews.  Also included in the rites were temple prostitutes.  Every kind of sexual practice was going on when worshiping these gods during this time including homosexual sex.  They felt that having physical contact with the priests of the gods and goddesses would bring them blessings.  Sexual intercourse was felt to gain great favor of the goddess because the male was offering his semen, thought to be the essence of life, to the goddess through the priest.  Depositing semen in the body of the priest was believed to be the way to eternal life.  Similar practices went on during this time in history through out the religion in worship of pagan deities.This is what was going on in Canaan and Egypt at the time the Levitical rules were announced --homosexual temple prostitution. And as already noted, Leviticus 18 and 20 specifically say that they were written to address pagan religious practices.

Leviticus 18 begins (18:3)  You shall not do as they do in the land of Egypt, where you lived, and you shall not do as they do in the land of Canaan where I am bringing you...

Leviticus 20 is even more specific even naming the pagan god Molech. 

So these verses which are quoted so often in condemnation of homosexuality, are actually in condemnation of idol, false god pagan practices.

Sodom and Gomorah in Genesis 19 

For years, this has been used by people to condemn homosexuality.  Let's look at the story a little more closely.  The Bible says that all the men of the city every single one of them both young and old came to Lot's house.  This is very telling.  The most "gay" city in the United States is arguably San Fransisco.  Yet, in this very "gay" city, less than half of the men are gay.  It stands to reason that if the Bible was talking about homosexuals, perhaps it would have been worded that "certain men of the city" or even "many men of Sodom".  It is not.  It says that every single one of the men and boys .... all of them to the very last man came to Lot's house.  To suggest that every single man in Sodom and Gomorrah was a homosexual is simply not credible.  From where did the children come if this was so.  I believe that something other than homosexual desire was going on here.  This is further proved accurate by Lot himself.  He offers his daughters, his virgin daughters to the men of Sodom and Gomorrah.  If these men were truly homosexual, what was Lot trying to accomplish here.  Lot knew the men at his door and knew them to be predominately heterosexual (his actions are reprehensible) which is why he offered his daughters. 

From ancient records, we know that at the time, the practice of the people of Sodom and of all the people of the area was to use rape of men by men to humiliate them.  "When victorious soldiers wanted to break the spirit of their defeated enemies, they would 'treat them like women'".  This is a story of mob violence, not of homosexual desire. 

So if homosexuality was not the sin of Sodom and Gomorrah, what was it that caused God to rain fire and brimstone.  Well, once again, the Bible has the answers to this.  The Bible itself tells us that it was not homosexuality that caused God to destroy these two cities.  The Bible mentions Sodom and Gomorrah twenty times in later scriptures and NONE of them states that their sin was homosexuality.   In the book of Ezekiel we find probably the most extensive references to Sodom and Gomorrah.  Ezekiel 16:49 & 50  This was the guilt of your sister Sodom: She and her daughters had pride, excess of food, and prosperous ease, but did not aid the poor and needy.  They were haughty and did abominable things before me; therefore I removed them when I saw it.

According to the Old Testament prophets, the sin of Sodom and Gomorrah was the fact that they behaved with "callous indifference" to those in need-- the widows, orphans, poor and the strangers in their midst.  In truth, this story is at best a condemnation of homosexual rape; and as other Scriptures affirm, it is more generally a condemnation of the mistreatment of those who are most vulnerable ....  It is ironic that the story of Sodom is now used by Christians to justify judgement toward another vulnerable group -- homosexuals. Romans 1:21-28

 21Because that, when they knew God, they glorified him not as God, neither were thankful; but became vain in their imaginations, and their foolish heart was darkened.

 23And changed the glory of the incorruptible God into an image made like to corruptible man, and to birds, and four-footed beasts, and creeping things.

 24Wherefore God also gave them up to uncleanness through the lusts of their own hearts, to dishonor their own bodies between themselves:

 25Who changed the truth of God into a lie, and worshiped and served the creature more than the Creator, who is blessed for ever. Amen.

 26For this cause God gave them up unto vile affections: for even their women did change the natural use into that which is against nature:

 27And likewise also the men, leaving the natural use of the woman, burned in their lust one toward another; men with men working that which is unseemly, and receiving in themselves that recompense of their error which was meet.

 28And even as they did not like to retain God in their knowledge, God gave them over to a reprobate mind, to do those things which are not convenient;

 

The apostle Paul is addressing the Roman people.  All accounts of this passage that I have studied (and there were a lot) agree on one thing.  Paul is talking to these people about idol worship.  God gives them over to their idol worship and the practice of homosexual relations in said pagan rituals.  That each of them agree upon.

 

1:24-25 The expression God gave them (parevdwken aujtouV" oJ qeov", paredoken autous ho theos) over means that the process envisioned in 1:18-32 is not simply the natural course of events but an ongoing history directed by a sovereign God who makes decisions which affect people, societies, and cultures. The thought is truly a frightful one. It is reminiscent of Pharaoh turning his back on God and in turn having his heart judicially hardened by YHWH (Exod 9:16; cf. Rom 9:17).

Though there is no mention of fire and brimstone at this point in Romans, there is a process underway that is not altogether distinct from hell. If people really want their sinful lifestyles, then the awesome reality is God will give them over to it. As C. S. Lewis as aptly remarked, “There are only two kinds of people in the end: those who say to God, ‘Thy will be done,’ and those to whom God says, ‘Thy will be done.’ All that are in hell chose it.” The point is, that although Paul is not talking about hell here, and indeed there is still hope for these people, there is nonetheless a continuum between their present existence and their future plight. If a person really wants God out of their thoughts, as these people most definitely do, Love has decided to provide a place in the end where they can choose to go and never have to think about him again.

There comes a time in the divine mind when people, who revel in the sinful desires of their hearts, are to be handed over to their desire for impurity, in particular, to the dishonoring (tou` ajtimavzesqai) of their bodies with one another. One should not miss the ideological connection here between the Gentiles’ idolatry and sexual sin—a connection which was commonly made in the Judaism of Paul’s day.

Wisdom of Solomon 14:12-14 reads: 12For the idea of making idols was the beginning of fornication, and the invention of them was the corruption of life; 13 for they did not exist from the beginning, nor will they last forever. 14 For through human vanity they entered the world, and therefore their speedy end has been planned (NRSV).

Though there is no explicit grammatical tie with verse 24, verse 25 makes it clear that sexual perversion is closely linked with idolatry. People have exchanged (methvllaxan, metellaxan) the truth about God’s existence and glory for the lie that he neither exists nor merits worship. Indeed, the irony of the whole thing is that they give religious worship and service to this lie (tw/` yeuvdei, to pseudei) when they give themselves to idolatry—the worship of the creation rather than the Creator. For idolatry is not just the worship of useless idols, it is the express proclamation that the biblical God does not exist. Such a thought is so abhorrent to Paul that he finds it necessary to invoke a blessing on God: “God is forever blessed!”

 

 

The Apostle Paul was a very educated man.  He addressed the facts of the time in a very logical and throughal progression.

1.  In verse 21 he addresses People who refuse to acknowledge and glorify God

2.  In verse 23, they were worshipping idols

3  They were interested in earthly things rather than the things of the Creator (verse 25)

4.  Gave up natural passion for the opposite sex in an "unbounded search for pleasure"

5.  Lived lives full of covetousness, malice, envy, strife, slander, disrespect for parents, pride and hatred for God

The model of homosexual behavior that Paul is addressing here is explicitly associated with idol worship (probably temple prostitution), and with people who, in unbridled search for pleasure (or because of religious rituals associated with their idolatry), broke away from their natural sexual orientation, participating in promiscuous sex with anyone available.   Paul simply does not address the issue of a stable, loving homosexual relationship among people of faith.

Why Passing the Uniting American Families Act Should be Important to Congress

The Uniting American Families Act would give Homosexual United States Citizens the right to sponsor their partners(for lack of a better legal word) for Green Card status. The heterosexual community has been enjoying this right since people have been falling in love with people from different countries. I believe that it is high time that the lesbian and gay community be afforded this simple right; the right to live with whom we love.

One argument is that passing the Uniting American Families Act would promote fraud. I read that people opposed to the UAFA feel that proving that a person is really in love with another person and wanting to spend the rest of their lives with that person is difficult without the bond of marriage. To that ludicrous and quite ignorant protest I answer: Allow us to get married then. There are ways, just as there are with heterosexual people, of proving a relationship. This really is a poor excuse for not passing the Uniting American Families Act.

Another argument is that allowing homosexual people to sponsor their partner is an affront and an attack on the family. US News and World Report reported way back in 2004 on the rise of the gay family. http://www.usnews.com/usnews/culture/articles/040524/24family.htm
Like heterosexual couples in a committed relationship, some want children and some don't want children. In no way is allowing people to have families an attack on the family.

I have heard that people do not think that homosexuals should be allowed to have children. Aside from the obvious grievous attack on the personal rights of human beings there are several studies saying that children of same sex couple do as well or better than their counterparts.

So the fact that people think that the United American Families Act is an attack on the family is also not accurate. All most of us want to do is to live in peace with our family without fear and hate.

Probably the most outspoken arguement from the opposition of the Uniting American Families Act is that God is against homosexuality. It seems that Congress has taken ahold of this and is using it for all bills that have to do with homosexuality. Sadly, a lot of the people making these statments have not picked up a Bible in years and are ignoring advice from all parents everywhere, "Learn to think for yourself and come to your own conclusions".
If God hates homosexuals, why is John 3:16 in the Bible? "For God so loved heterosexual people..." No, it says "For God so loved the world..."

If God hates homosexuals, why did Jesus heal the Centurion's beloved servant?

For those who still think that God destroyed Sodom and Gomorrah because of homosexuality...that is so not right. Read your Bible:

Ezekiel 16:49
49 " 'Now this was the sin of your sister Sodom: She and her daughters were arrogant, overfed and unconcerned; they did not help the poor and needy.

The verses used at a lot of heterosexual weddings to pledge their lives to each other forever are words that were spoken between two women. Ruth 1:16 & 17

God does not hate homosexuals. It is simply not Biblical for anyone (even the Pope) to say that God does not love homosexuals. Shame on the Church for straying so far away from the Word of God and allowing centuries of prejudice to influence their thinking and not do their own research.

Congress should pass the Uniting American Families Act on principle. Are we less of American Citizens because we are homosexual? Do we not have the right to be in love with whom we have fallen in love? Are we not entitled to the same rights as Americans because of sexual preference. While the government encourages businesses to not discriminate on the basis of color, sex, age, or sexual orientation, they are GUILTY of these very discriminatory acts.

I am an American and as an American I am guarenteed rights by our Constitution. I ask that the Uniting American Families Act be passed so that I and thousands like me can have the right to live in our country with the person we love, with the families we love. We need to be allowed this right as Americans.

PASS the UNITING AMERICAN FAMILIES ACT. It is the right thing to do, it is the Christian thing to do, it is the American thing to do.
